Terms of Service
Effective date: 18 April 2026
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the website, platform, and services provided by Castreal (legal entity registration pending) ("Castreal", "we", "us", or "our"), based in Romania.
By accessing or using our website at castreal.io or any associated services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, please do not use our Services.
2. Service Description
Castreal is a licensed talent marketplace for AI-generated advertising campaigns. Our platform enables brands, agencies, and creative professionals to license real human faces, with documented consent, for use in AI-generated commercial content including images and video.
Key features of our service include:
- A curated library of verified, consenting human talent
- Flat-fee licensing (from €29 per face)
- Clear usage rights and restrictions for every licensed face
- GDPR and EU AI Act compliance built into the licensing model
Current status: Castreal is currently in early access / pre-launch. During this phase, the Services are limited to browsing a preview catalog and signing up for early access via email. Full licensing and content generation features will become available at launch.
3. Eligibility
To use our Services, you must:
- Be at least 16 years of age.
- Have the legal capacity to enter into a binding agreement.
- If acting on behalf of a company or organization, have the authority to bind that entity to these Terms.
Our licensing services are designed for professional and business use. By licensing talent through Castreal, you represent that you are acting in a business or professional capacity.
4. Early Access
During our pre-launch phase, you may sign up by providing your email address. This gives you access to our catalog preview and priority notification when the full platform launches.
Signing up for early access does not create an account and does not obligate you in any way beyond these Terms. No payment is required during early access.
You agree to provide accurate information when signing up. We reserve the right to remove entries that contain false or misleading information.
5. Face Licensing Terms
When the platform is fully launched, Castreal will offer licenses to use AI-generated content featuring the likeness of real, consenting individuals ("Talent"). The following terms will apply to all licenses:
5.1 License Grant
Upon full payment of the applicable license fee, Castreal grants you (the "Licensee") a non-exclusive, worldwide license to use the AI-generated content featuring the licensed Talent's likeness ("Licensed Content") in your advertising and creative projects, subject to the restrictions in Section 6.
5.2 License Scope
- The license permits use in commercial advertising, marketing campaigns, and promotional materials.
- You may use the Licensed Content across any media format, including digital, print, broadcast, and social media.
- License duration and specific terms will be detailed in the license agreement at the time of purchase.
5.3 Pricing
Licensing is offered on a flat-fee basis, starting from €29 per face. Final pricing will be published on the platform at launch. All prices are in EUR and exclude applicable VAT.
5.4 What the License Does Not Grant
- No ownership of the Talent's identity, likeness, or personality rights.
- No right to sublicense, resell, or redistribute the raw face assets as standalone files.
- No right to use the Talent's likeness outside the scope of the license agreement.
6. Acceptable Use & Prohibited Uses
This section is critical to protecting both the Talent whose faces appear in Licensed Content and the integrity of the marketplace. By using our Services, you agree to the following restrictions:
6.1 Prohibited Uses of Licensed Content
You may not use Licensed Content to:
- Create deepfakes or misleading identity representations. You may not use the Licensed Content to create realistic impersonations that could deceive viewers into believing the depicted person actually said, did, or endorsed something they did not.
- Political advertising. You may not use Licensed Content in political campaign materials, partisan advocacy, or political endorsements.
- Adult or sexually explicit content. You may not use Licensed Content in pornographic, sexually explicit, or adult entertainment materials.
- Defamatory, discriminatory, or hateful content. You may not use Licensed Content in any context that is defamatory, harassing, discriminatory on the basis of race, gender, religion, nationality, disability, sexual orientation, or age, or that promotes hatred or violence.
- Medical or health claims. You may not use Licensed Content to imply that the Talent endorses, uses, or recommends specific medical treatments, pharmaceuticals, or health products.
- Implied personal endorsement. You may not represent that the Talent personally endorses, supports, or uses your product or service unless you have obtained a separate, explicit endorsement agreement directly with the Talent.
- Sublicensing or redistribution. You may not sublicense, resell, or distribute the Licensed Content as standalone assets (e.g., offering the face images on another marketplace or stock platform).
- AI training or facial recognition. You may not use Licensed Content to train artificial intelligence models, machine learning systems, or facial recognition technologies.
- Sensitive or damaging contexts. You may not use Licensed Content in contexts that could reasonably damage the Talent's reputation, including depictions involving criminal activity, substance abuse, or extreme violence.
6.2 EU AI Act Transparency Requirements
Under the EU Artificial Intelligence Act, AI-generated content that depicts real persons must be clearly identified as AI-generated. As a Licensee, you are required to:
- Label all AI-generated content. When publishing Licensed Content, clearly disclose that the content was generated using artificial intelligence.
- Do not present AI content as authentic footage. You must not misrepresent AI-generated content as real photography or video of the Talent.
- Comply with applicable transparency laws. You are responsible for compliance with all applicable transparency and disclosure requirements in your jurisdiction.
6.3 General Platform Rules
You may not:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to reverse-engineer, decompile, or extract the AI models or algorithms used by Castreal.
- Interfere with or disrupt the integrity or performance of the Services.
- Circumvent any access restrictions, rate limits, or security measures.
- Impersonate another person or entity when using the Services.
7. Intellectual Property
7.1 Platform Ownership
Castreal owns all rights, title, and interest in the Services, including our website, software, AI models, trademarks, and visual design. Nothing in these Terms grants you any rights to our intellectual property except the limited license expressly described in Section 5.
7.2 Talent Rights
Each Talent retains their personal rights to their name, likeness, and identity. The license granted to you covers only the specific AI-generated content produced through the platform. It does not transfer any underlying personality or publicity rights of the Talent to you.
7.3 Licensed Content
AI-generated content may have limited or no copyright protection in certain jurisdictions (as AI authorship may not qualify for copyright). Regardless of copyright status, your use of Licensed Content is governed by the license terms in Section 5 and the restrictions in Section 6. You may use the Licensed Content for the permitted purposes, but you may not claim exclusive ownership that would prevent Castreal or the Talent from authorizing similar content for others.
8. Payment Terms
During the pre-launch / early access period, no payment is required.
When the platform launches, the following terms will apply:
- License fees are due at the time of purchase.
- All fees are in EUR. Applicable VAT will be added based on your location.
- Payments are non-refundable once the Licensed Content has been delivered, except where required by applicable consumer protection law.
- We may change our pricing at any time. Price changes will not affect licenses already purchased.
9. Disclaimers
The Services are provided on an "as-is" and "as-available" basis, particularly during the early access phase. To the maximum extent permitted by law:
- We make no warranties, express or implied, regarding the Services, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee that AI-generated content will meet your specific requirements or that it will be error-free.
- We do not guarantee uninterrupted or secure access to the Services.
Nothing in these Terms excludes or limits our liability for matters that cannot be excluded by applicable law, including liability for fraud, death, or personal injury caused by negligence.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Castreal's total aggregate liability to you for any claims arising out of or related to these Terms or the Services shall not exceed the total amount you have paid to Castreal in the 12 months preceding the claim.
- Castreal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
These limitations apply whether the claim is based on contract, tort, strict liability, or any other legal theory.
11. Indemnification
You agree to indemnify, defend, and hold harmless Castreal, its directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Services or Licensed Content in violation of these Terms.
- Your use of Licensed Content in any prohibited manner described in Section 6.
- Your violation of any applicable law or regulation.
- Any third-party claim that your use of Licensed Content infringes their rights.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
If you are a consumer in the European Union, you also enjoy the protection of mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under such mandatory laws.
13. Dispute Resolution
We encourage you to contact us first at hello@castreal.io to resolve any disputes informally.
If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts in Bucharest, Romania, subject to any mandatory consumer protection rules that may grant you the right to bring proceedings in your country of residence.
For consumers in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if:
- You violate any provision of these Terms, particularly the Acceptable Use restrictions in Section 6.
- We are required to do so by law or regulatory order.
- We discontinue the Services (in whole or in part).
Upon termination:
- Licenses for Licensed Content that have been fully paid for and delivered prior to termination remain in effect, subject to the restrictions in these Terms.
- Your right to access the platform and any unpaid or pending orders is revoked.
- Sections 6 (Acceptable Use), 7 (IP), 9–11 (Disclaimers, Liability, Indemnification), 12 (Governing Law), and 13 (Dispute Resolution) survive termination.
15. Modifications to These Terms
We may update these Terms from time to time. When we make changes, we will:
- Update the "Effective date" at the top of this page.
- For material changes, provide at least 30 days' notice before the new terms take effect, via email or a prominent notice on our website.
Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Services.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
